Terms of Service

These Terms of Service ("Terms") govern your access to and use of 44s cloud computing services ("Service") provided by 44s ("we", "us", or "our"). By using our Service, you agree to be bound by these Terms.
1. Service Description
44s provides high-performance, lock-free cloud computing infrastructure, including but not limited to:
- Redis-compatible cache services
- Database acceleration services
- Compute optimization services
Our Service utilizes proprietary Fractal Arrays technology to deliver superior performance compared to traditional lock-based systems.
2. Account Registration
To use our Service, you must:
- Provide accurate and complete registration information
- Maintain the security of your API keys and credentials
- Promptly notify us of any unauthorized access
- Be at least 18 years old or have legal authority to enter into this agreement
3. Acceptable Use
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems
- Conduct cryptocurrency mining without prior approval
- Store or transmit illegal content
- Engage in activities that disrupt or degrade the Service
4. Payment Terms
- Billing: Services are billed based on usage as specified in your service agreement
- Payment: Payment is due within 30 days of invoice date
- Late Payment: Overdue accounts may result in service suspension
- Refunds: Unused prepaid credits may be refunded within 30 days of purchase
- Price Changes: We will provide 30 days notice before any price increases
5. Service Level Agreement
We target 99.9% uptime for our production services. In the event of downtime exceeding this target, eligible customers may receive service credits as outlined in their service agreement.
6. Data Handling
- You retain ownership of all data you store on our Service
- We will not access your data except as necessary to provide the Service or as required by law
- Data is encrypted in transit and at rest
- Upon termination, you may request data export within 30 days
7. Intellectual Property
The Service, including our Fractal Arrays technology, software, and documentation, is protected by intellectual property laws. You may not reverse engineer, decompile, or attempt to extract the source code of our proprietary technology.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of profits, data, or business opportunities
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Termination
- You may terminate your account at any time by contacting support
- We may suspend or terminate service for violations of these Terms
- Upon termination, your right to use the Service immediately ceases
- Sections regarding liability, indemnification, and intellectual property survive termination
11. Modifications
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
13. Dispute Resolution
Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
